Halle Berry got dealt a big blow today in her custody fight with Gabriel Aubry.  A judge ordered her to pay Aubry $20,000 a month for the support of Nahla.  Halle still wants to take Nahla to France and Aubry is deadset against it.  The judge hasn't made a decision on that request yet.  Gabriel feels Halle just wants to take Nahla to France to keep him away from her as much as possible.

Halle Berry and Gabriel Aubry have been in a bitter custody battle over their daughter Nahla for the last few months.  Today, Halle just got a received a major step towards being able to move daughter Nahla to France, which Gabriel has vehemently been trying to fight.  TMZ reports:

The all-important custody evaluation has been written and submitted to the judge in the Halle Berry/Gabriel Aubry custody war — and sources tell TMZ the conclusion is clear — Halle is the better parent, and that clears the way for her move to Paris.


 


The custody evaluator — a psychologist — wrote the report after extensive interviews with Halle, Gabriel, 4-year-old Nahla and others.  Sources tell TMZ … the report raises issues about Gabriel's ability to care for Nahla, in part because of personal issues.  We're told the evaluator did not question Gabriel's love for his daughter or her love for him, but the report does cast doubt on his ability to assume responsibility for the custody and care for the little girl.





Now here's where it gets interesting … The judge will decide the custody arrangement later this month, and whether Halle gets to move to Paris with Nahla — something Gabriel vigorously opposes.





Under California law, the judge cannot question the fact that Halle is moving to Paris.  He can't tell her she's not allowed to move, nor can he conclude that she's bluffing.  The judge must accept AS FACT that Halle is moving to France.





The judge must then decide what is in the "best interest" of Nahla — being with Halle full time or being with Gabriel.  Given the conclusions in the custody evaluation report, it's pretty clear the judge will decide Nahla is best served by being with Halle.  So Halle now has a huge advantage in her bid to move to France with the kid.  





If Halle is allowed to move, it's almost certain Gabriel would get visitation rights, but that's easier said than done when Nahla is 5,600 miles away.

Gabriel Aubry had a rough day today.  He was in court and TMZ reports:

 

Halle wants to move to Paris with Nahla and fiance Olivier Martinez. Sources tell us Halle's lawyer will ask Gabriel about his work commitments. We're told he works very sporadically as a model and Halle believes he can still maintain a meaningful, long-distance relationship with Nahla as a result.

 

Gabriel is strongly opposed to allowing Halle move Nahla to France.  The lawyer reportedly will ask about finances, child support and the neglect charges.

You would never guess that Gabriel Aubrey was involved in a bitter custody battle with Halle Berry over their daughter Nahla.  Gabriel was seen out yesterday, in West Hollywood, spending time with his daughter, seemingly not a care in the world.  Meanwhile, half-way around the world in France, Halle Berry and Oliver Martinez were seen scouting out possible schools for Nahla.

 

Halle is doing this as a judge has not ruled as to whether she can move Nahla to France.  Aubrey is able to breathe a sigh of relief, though, as the child endangerment case was dropped against him a couple of weeks ago.  Last month, Halle asked a judge if she could move to France over fear for her safety and Nahla's safety, over an alleged stalker.  She also has recently become engaged to Oliver Martinez.  Halle recently let go of her original attorney, Neal Hersh who was handling the case and hired an attorney, Stephen Kolodny, known to use tough tactics in child custody cases.

 

Gabriel feels, Halle asking to move Nahla to France, is just an attempt to keep him separated from his daughter and is fighting Halle's request.  He is not afraid of Halle's new attorney and feels that Halle;s impatience is showing and will help him in his custody fight.   He has asked for Halle to have to pay child support and for clothing and a host of other things.  This battle has been going since 2010 and continues to get ugly.

The custody battle between Gabriel Aubry and Halle Berry has gotten worse.  Halle Berry filed papers a few weeks ago asking a judge to allow her to move to France with Nahla and a judge ordered supervised visitations with Gabriel a few weeks back. He also has to attend anger management classes.

 

Reports say Halle wasn't happy that the judge hasn't ruled on her request to move to France, that she fired her longtime attorney, Neal Heash, and hired a more aggressive attorney, Stephen Koldny, who is known to get the job that Halle Berry wants done.

 

 

 

Radaronline reported that Gabriel and his lawyers are unfazed by Halle's new moves and actually feels it may help his case.  He feels it shows how "desperate" and "impatient" Halle is. They also report Gabriel is getting offers to  do tell-all books about Halle and expose her for who she really is.  His friends and family feel that in the press, Halle is making him look bad.   He has been said to turn them all  them down as he feels when Nahla grows up she will be able to see and read these things.  Everything he does is in her best interest.

 

 

Now, Gabe may be flexing his legal muscle.  TMZ is reporting that wants little Nahla to live in the same type of home she is accustomed to and he wants Halle to foot the bill.  He filed legal docs asking the court to make Halle cough up between $15,000 to $20,000 per month for a home.  That's not all.  He also wants lots of money for Nahla's clothing an money for him to take Nahla to court to visit his family in Canada.

 

 

Halle is said to be very unhappy with this new development and fighting hard not to get this request honored.  Also, the judge in the custody case is expected to rule April 9, because that judge wants to see what happens with the dependency court which could affect any child support Halle would have to pay.

Gabriel Aubrey was spotted out with he and Halle Berry's duaghter.  They appeared to be having a wonderful time.   He let her frollick around. You would never guess that a bitter custody battle was being waged right now.

 

A few weeks ago, Halle Berry asked a judge to allow her to move to France with Nahla because she fears for her daughter's and her own safety.  Halle has since had two stalkers and one of which that escaped but was later apprehended.

 

It has just been revealed a few weeks ago that Halle and her beau Oliver Martinez are engaged.  Gabriel is vehemently fighting allowing Halle to move to France because he and feels this is Halle's attempt to keep him away from Nahla. The court has already ordered he has supervised visits with the child.

Halle Berry: Good News Bad News?

 

Per TMZ, There is some really good news for Halle Berry!!   Turns out she is engaged to beau Oliver Martinez. Halle is asking the courts to allow her to move to France.

 

For the bad news, Halle's safety is at risk.  Turns out that Halle has two known stalkers.  One stalker, Robert Hoskins escaped from a mental asylum about a week ago and has made threats against the actress' life stating he would "slit her throat".

The other stalker just recently got released from the pokey!

 

She feels staying put in L.A. is a danger to her life and Nahla's safety so she is asking to be allowed to move not in retaliation to Gabriel but for she and her daughter's safety.  A hearing is pending for a judge to render a decision.

 

Update: The stalker who espcaped that has threatned Halle's Life has been apprehended Friday and returned to the Mental Hospital in Norwalk.  He was considered "highly psychotic" &  extremely violent.

In what's becoming an epic custody battle, Halle Berry and Gabriel Aubrey are in court today to work out the details of visitation.  They have already previously been to court over visitation and had come to a settlement.  Last week, Halle's nanny claimed that she went to pick up Nahla from her school and she wasn't there.  

She then says she went to Gabriel's home and asked why he didn't take her to school.  In the end, she claims she Gabriel pushed her while Nahla was in her arms.  She filed for a restraining order against him and it was denied.  

 Fast-forward to today and they are in court to determine visitation.  Halle wants Gabriel to have supervised visitation.   Gabriele is claiming Halle's nanny is makig up the story to sway favor to Halle.  Here is what has been ruled so far:

1. Counseling for Nahla 

2. Both parents take parenting classes to be better parents     

3. Gabriel to take anger management classes which he has agreed to. 

4.  Gabriel wants the Nanny Fired

 

Update:  Counseling has been recommended for all three Gabriel, Halle and Nahla.  It doesn't appear that any terms will be able to be reached amicably so the judge may have to have a full trial to be the deciding factor into what happens with Nahla.  Sad situation.

Update:  The judge has ruled that Gabreil will not lose custody of Nahla while he is being investigated for the previous charges.  It is no final and there will be some changes made to custody but they have not been announced.  Still developing!

        

This is a sad situation for everyone involved and we hope they can come to an amicable agreement.  Story Developing……

 

Update: Aubrey had been summoned by the courts because they are concerned if he can care for Nahla.  Nahla has been appointed counsel  DCFS is concerned about Nahla's safety when in the care of her father, Gabriel.  It is concened about incidents beyond what happened with the nanny.  Story still developing…….
